The Website www.bvalve.es is owned by Bvalve Flow Systems And Controls, S.L. and it complies with the requirements arising from Law 34/2002, of 11 July, on Information Society Services and E-Commerce, as well as regulations in force related to personal data protection and, in particular, Regulation (EU) 2016/679 of the European Parliament and of the Council, of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

Bvalve Flow Systems And Controls, S.L. reserves the right to amend or adapt this Privacy Policy at any time. Therefore, we recommend you revise this Privacy Policy every time you access the Website. In the event that the user has registered on the Website and they access their account or profile, upon accessing the same, they will be informed if there have been any substantial amendments to how their personal data are processed.

When, why, whom, how, for what purpose and for how long do we process your personal data?

When and why?

You may browse on the majority of our web pages without providing any personal information but in some cases said information is necessary to offer you the electronic services you request from us.

If we need to collect personal data to provide you with the service, we will process your information in accordance with the policy outlined herein and in the Special Terms and Conditions of the specific service in question (if there are any), which contain specific privacy declarations on the use of data. You are hereby informed as to why, for what purpose, how, and for how long we process your personal data, in addition to the security measures we implement.

Who gathers your data?

Collection and processing of the personal data you may facilitate are developed by our entity or, if applicable, its data processors. Data processors are third parties who are required, by virtue of a contract, to respect the law and implement suitable security measures to protect said data.

For what purpose?

The personal data we request from you, or that you provide us with by browsing, help us manage, provide and improve the services you request from us.

For example, we will process your personal data to manage the queries you send us, to manage your participation in staff recruitment processes, to send you electronic correspondence if you request this from us, and/or to prepare statistics.

In this regard, we ask you for an email address when you use our contact forms on our website. We only collect the personal data required from the sender to respond to their query.

When you subscribe to our newsletters, we also ask you for an email address to provide you with said service. In any case, you may unsubscribe from this service at any time, and we have made the appropriate means available to you so you may do so.

How do we process your data?

We exclusively collect personal data to the extent necessary to achieve a specific purpose. This information will not be used for a purpose that is incompatible with the purpose described herein.     

We only disclose information to third parties if it is necessary to do so to fulfil the purpose of the service and, in any case, only to the people who need to know said information. Of course, this is all with the aim of being able to provide the service by processing your personal data confidentially and discretely, in accordance with legislation in force.

We process your personal data to (i) manage your purchase or the service provided; (ii) maintain the contractual and pre-contractual relationship for billing, the creation and tracking of quotes, and to send you information via electronic means in relation to your request; (iii) send correspondence on commercial information that may be of interest to you, via electronic means, provided that you have expressly authorised us to do so; (iv) create a commercial profile based on the information you provide us, with a view to offering you products and services in accordance with your interests. No automated decisions will be taken based on this profile.

• Suppliers:

We process your personal to (i) send invoices; (ii) maintain the commercial agreement; (iii) send you information on our products or services via electronic means.

• Website or email contacts:

We process your personal data to (i) respond to your queries and requests; (ii) manage the service requested or process your order; (iii) send you commercial information that may be of interest to you, via electronic means, provided that you have expressly authorised us to do so; (iv) create a commercial profile based on the information you provide us, with a view to offering you products and services in accordance with your interests. No automated decisions will be taken based on this profile.

• Social network contacts:

We process your personal data to (i) respond to your queries and requests; (ii) manage the service requested, answer your request, or process your order; (iii) interact with you and create a community of followers.

• Job applicants:

We process your personal data to (i) include you in recruitment processes; (ii) invite you to job interviews and assess your candidacy; (iii) pass on your CV to group companies, collaborators or similar entities with the sole aim of having you participate in recruitment processes, provided that you have granted your consent to this.

• Participants in our competitions:

We process your personal data to manage your participation in the competitions we organise, and to publicly inform you of competition winners and the prize-giving event.

Prize winners will be photographed or recorded on video, and these will be publicised using any communication method, our website, or other communication channels. As a result, participants’ images may be captured, recorded and/or copied as an action secondary to the main activity.

• Website users:

By browsing on our website, we gather information on your browser, device and data on the use you make of our website, in addition to any information that you provide us with when using our website. We may record your IP address (number identifying your device’s access to the Internet, which allows devices, systems and servers to recognise and communicate with each other), either anonymously or in aggregation.

The purpose of processing is to (i) obtain practical knowledge of how users use our website, which allows us to improve it; (ii) develop statistical analysis that helps us to improve our commercial strategy; (iii) perform website performance analysis; (iv) ensure technical security and perform system diagnosis.

The data we obtain are not related to a specific user and they will be stored in our databases.

In a bid to offer information or services of interest based on a user’s location, we may access data related to the geolocation of the user’s device in cases in which the user’s pertinent settings permit this.

Any personal information that is collected through these applications may be used by third-party users of the same. What is the legal basis for processing your data?

• Customers:

The legal basis for processing your data is (i) execution of a contract and maintenance of the contractual relationship; and (ii) your consent that is requested from you so we may send product and service offers via electronic means, with withdrawal of your consent not affecting execution of the contract under any circumstances. 

• Suppliers:

The legal basis for processing your data is (i) execution of a contract in which the supplier in question is a party, or to apply pre-contractual measures.

• Website or email contacts:

The legal basis for processing your data is (i) the interested party’s consent.

In cases where a form must be completed and the “send” button clicked to make a request, doing so will necessarily imply that you have been informed and expressly granted your consent to the content of the clause attached to said form or that you accept the privacy policy.

All of our forms include a confirmation box that you must check to access the services they offer.

The purposes of processing will be as follows:

1. To manage the queries or requests for information you send to us via the Website, email or telephone.
2. To send correspondence, special promotions, news or initiatives that may be of interest to you or that you request from us, even via electronic channels. As this purpose is secondary to the main purpose, you must check the box provided.

The personal data that you provide us with via this method will not be shared with third parties as Bvalve Flow Systems And Controls, S.L. will provide a direct response to this type of query.

• Social network contacts:

The legal basis for processing your data is acceptance of the contractual relationship with the corresponding social network supplier, which is declared when registering on their application, in accordance with their privacy policies, which are external to us.

• Work with us:

In the event you send us your curriculum vitae, either via the Website, email or physically by post sent to our address or at any office of Bvalve Flow Systems And Controls, S.L., this will be included in our database. Your curriculum vitae will be stored for one year, after which it will be removed if we have not contacted you.

The legal basis for processing is the express consent granted by the interested party in relation to processing of the data contained in their curriculum vitae upon sending it and checking the box provided.

The purpose of processing is to include the interested party in current and future recruitment processes at Bvalve Flow Systems And Controls, S.L., or any entity pertaining to the business group.

If the interested party joins Bvalve Flow Systems And Controls, S.L. or any of the entities pertaining to the business group as an employee, their information will be included in a database owned by the same so the employee-employer working relationship may be managed internally.

• Sending of the newsletter:

Our Website offers you the chance to subscribe to the Bvalve Flow Systems And Controls, S.L. newsletter. To do so, you must provide us with an email address, to which it will be sent.

This information will be stored in a Bvalve Flow Systems And Controls, S.L. database, where it will remain recorded until the interested party unsubscribes or, if applicable, Bvalve Flow Systems And Controls, S.L. ceases to send its newsletter.

The legal basis for processing this personal data is the express consent granted by all interested parties who subscribe to this service by checking the box provided.

Email address information will only be processed and stored for the purpose of managing delivery of the newsletter on behalf of the users who request this service.

• Participants in our competitions:

The legal basis for processing is your consent upon registering for the competition and accepting the privacy policy and competition terms and conditions.

The personal data that are gathered will not be transferred to third parties.

• Website users:

The legal basis for processing is our (i) legitimate interest in understanding our users’ browsing habits in order to adapt to their interests and improve our relationship with them; and (ii) their consent to browsing on our Website and acceptance of the Cookies Policy.

Who will your data be communicated to?

Your data will not be transferred to third parties external to the service we provide, unless we are legally obliged to do so. Specifically, they will be communicated to the State Tax Administration and to banks and financial institutions for payment of the service provided or product purchased.

Your data may also be communicated to our service providers when necessary to execute the contract. In these cases, the data processor has signed a contract stating that it will only use your data for the purpose that justifies processing and that it will implement all appropriate security measures.

What are your rights when you provide us with your data?

Right of access: You can ask us if we are processing your data and how.

Right to rectification: You can ask us to update your personal data if they are incorrect, and to have them removed if you wish.

Right to restrict processing: In this case, we will only store your data to exercise or defend against claims.

Right to object: After you communicate your objection to processing, we will cease to process your data in the manner you indicate, unless we must continue to do so on compelling legal grounds or to exercise or defend against possible claims.

Right to data portability: If you wish your data to be processed by another company, we will facilitate your data being transferred to the new data controller.

Right to erasure: You may ask us to erase your data when they are no longer necessary for processing, you withdraw your consent, processing is illegal, or there is a legal obligation to do so. We will analyse your case and apply the law.

You may contact our Data Protection Officer prior to filing a claim with the Spanish Data Protection Agency against the data controller.

If we have not addressed your request to exercise your rights, you may file a claim with the Spanish Data Protection Agency.

We have forms available so you may exercise your rights. These should be sent to the email address indicated above; you can also use the forms offered by the Spanish Data Protection Agency or third parties. These forms must be signed electronically or accompanied by a photocopy of your identification document. Similarly, if you would like to use a representative, your request must be accompanied by a photocopy of your identification document or electronic signature.

Forms must be submitted in person or sent by post or email to the addresses that appear in the “Data Controller” section. 

We have one month to respond to your request, counted from the date it is received.

How long do we store your data for?

Personal data will be stored while the link with us is maintained.

When it ends, the personal data processed for each of the purposes indicated herein will continue to be stored for the time frames established in law. If there is no legal time frame, they will be stored until the interested party requests that they be erased or they withdraw their consent, or within the time frame that a judge or court may request, bearing in mind the statute of limitations for legal actions.
